Terms of service

Purpose. These terms govern the use of the Webdiffusion platform (manager, studio, applications and broadcasting services), published by Live Stream Factory, a French SARL with a share capital of €1,000, SIREN 991127382, Gradignan, France. By using the platform you accept them. The commercial agreement signed with the customer account prevails in case of conflict.

Accounts and access

A customer account is opened by Live Stream Factory for an organization. Its administrator invites users and sets their roles. Each user is responsible for keeping their access confidential and for the actions carried out under their identity. Invitation and session links are personal.

The service

Webdiffusion lets you capture, mix, record and broadcast live programs. The service is provided "as is", with a level of quality that we measure and document, but without a guarantee of absolute availability: a live show also depends on your networks, your equipment and third-party platforms. We recommend testing in real conditions before any event.

Your content

You remain the owner of everything you produce, record or upload to the platform. You only grant us the technical right to process it in order to provide the service. You warrant that you hold the necessary rights on the content you broadcast (images, music, people filmed) and undertake not to broadcast unlawful content.

Third-party platforms

Broadcasting to YouTube, Facebook, LinkedIn or any RTMP/SRT service is done under your own account with those platforms and according to their own terms. For YouTube, by authorizing Webdiffusion through Google you also agree to the YouTube Terms of Service; our use of your Google data is described in the privacy policy. You can withdraw this authorisation at any time.

Third-party components

Open-source software. The Webdiffusion applications ship open-source components (including FFmpeg, x264, Opus, SRT and OpenSSL). These components remain governed by their own licenses, whose text is delivered with each application; the corresponding sources of the GPL and LGPL components are published at updates.webdiffusion.com/ffmpeg-sources.

NDI®. The Software includes components of the NDI® Software Development Kit licensed from Vizrt NDI AB ("NDI"). NDI® is a registered trademark of Vizrt NDI AB (ndi.video). With respect to these components, you agree that: (a) you shall not modify, translate, reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, algorithms or protocols of the NDI components or of any protocol they use, nor attempt to do so; (b) you shall not circumvent any technical limitation of the NDI components; (c) you shall not remove, obscure or alter any proprietary notice or label contained in or on the NDI components; (d) the NDI components are provided "as is" and NDI and its licensors disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement; (e) to the maximum extent permitted by applicable law, NDI and its licensors shall not be liable for any direct, indirect, incidental or consequential damages arising from the use of the Software or of the NDI components; (f) you shall comply with all applicable export control laws and regulations, including those of the United States, and shall not export or re-export the NDI components in violation of such laws; (g) the NDI components are copyright © NDI and its licensors, all rights reserved; (h) if you use the Software to develop products that rely on the NDI components, you shall comply with the NDI SDK license terms, maintain current and complete NDI compatibility, and include these same terms in your own end user license agreement.

Prohibited uses

Circumventing security mechanisms, using the platform to harm third parties, reselling the service without written agreement, or broadcasting content that is unlawful or contrary to the rules of the destination platforms.

Liability

Live Stream Factory provides the service with professional care. Its liability shall not exceed the amounts paid by the customer account over the last twelve months, and does not cover indirect losses nor interruptions attributable to networks, the customer’s equipment or third-party platforms.

Termination

The customer account may be closed according to the commercial agreement. We may suspend an access in case of manifest breach of these terms, after informing you unless urgent. On closure, your content is deleted as described in the privacy policy.

Governing law

French law. Courts of Bordeaux, unless mandatory provisions provide otherwise.
